Prosecutors, defense to meet on Bashara case

By George Hunter
The Detroit News

Detroit — Prosecutors and defense attorneys are scheduled to meet this afternoon to discuss the case against Robert Bashara, the Grosse Pointe Park man accused of scheming to have his former handyman killed.

A pretrial conference is set for 1 p.m. today before Wayne Circuit Judge Bruce Morrow in the case against Bashara, whom prosecutors say colluded with a furniture store owner to have his former employee, Joseph Gentz, killed in the William Dickerson Detention Facility, where Gentz is incarcerated on charges that he murdered Bashara's wife, Jane Bashara.

...

Gentz last week waived his right to a preliminary examination and was ordered to stand trial. His arraignment on information in Wayne Circuit Court originally was set for this afternoon, although it was rescheduled for Oct. 16 before Judge Vonda Evans.

Lindsey suggested during a June hearing that prosecutors and Gentz's attorney Susan Reed would work on a plea deal, although Reed said last week no deal had been reached.

Prosecutors said earlier that in taped jailhouse conversations, Bashara also indicated that he was interested in a plea deal.

Bob Bashara was charged with solicitation to commit murder.

In court on Thursday, the 54-year-old said he "foolishly and regrettably" had offered to pay a man to find someone to kill Joe Gentz.

Bashara pleads guilty in plot to kill handyman

By George Hunter
The Detroit News

He read a written statement: "In June of 2012, I foolishly and regrettably offered to pay Steve Tibaudo to find someone to kill Joseph Gentz. This took place in Wayne County."

Sentencing will take place on Nov. 20.

Both Assistant Wayne County Prosecutor Lisa Lindsey and defense attorney Mark Kriger agreed on most of the sentencing guidelines except for the degree of victimization in the case.

The defense believes sentencing guidelines call for Bashara to serve 51-85 months; the prosecutors are calling for 81-135 months.

Prosecutors say Bashara colluded with Tibaudo, a furniture store owner, to have Gentz killed in the William Dickerson Detention Facility, where Gentz is incarcerated on charges that he killed Jane Bashara.

Wayne County Prosecutor Kym Worthy also charged Gentz with solicitation of murder, meaning she believes someone else helped him slay the 56-year-old marketing executive, whose body was found inside her SUV in a Detroit alley on Jan. 25.

Figure in wife's death pleads guilty in tied case

Published : Thursday, 11 Oct 2012, 1:45 PM EDT

DETROIT (AP) — A Detroit-area man considered a person of interest in the investigation of his wife's strangulation has pleaded guilty to soliciting the murder of the man awaiting trial in her death.

Robert Bashara (buh-SHER'-uh) of Grosse Pointe Park made the plea Thursday in Wayne County Circuit Court.

A plea agreement calls for him to get a minimum sentence of four years, three months in prison at his sentencing Nov. 20.

Bashara now admits he hired a hit man to kill handyman Joe Gentz. Authorities say Bashara feared Gentz would identify him in the January death of Jane Bashara.

Gentz awaits trial on charges he murdered Jane Bashara, found dead in her car in Detroit.

Robert Bashara says he had no role in his wife's killing.

Bob Bashara's guilty plea engages Metro Detroiters on social media with passionate reaction

...

News of Bashara's plea, which could lead to at least four years in prison, drew plenty of reactions from Metro Detroiter's following a case that's made national news.

Some folks didn't appear surprised because they believe there's no way Bashara and his legal council could convince a courtroom he didn't conspire to kill Gentz.

You can find plenty of reaction about Thursday's news below; it's unclear what kind of impact Bashara's plea could have with the Jane Bashara murder trial.

Gentz is currently charged with the murder of Jane Bashara and had a in July an IQ that his defensive attorney said is hovering near mental retardation.

Family of suspect in Jane Bashara's murder says Bob Bashara set him up

GROSSE POINTE PARK, Mich. -
Grosse Pointe Park's Bob Bashara took a plea deal on Thursday, admitting he tried to have a suspect in his wife's murder killed while the suspect was behind bars.

That suspect, Joe Gentz, faces murder charges in the death of Bashara's wife, Jane Bashara. For the first time since the case broke in January, Gentz's mother is reacting to Bashara's role in his wife's murder case.

"It's been a nightmare," said Joanne Gentz. "(Bob Bashara) took advantage of my son and he got away with it."

Joanne said Bashara's plea deal has confirmed what she has felt all along.

"Bob Bashara, he set my son up," she said. "I mean, I really believe that. Because Joe is a good kid. It's just, you know, he listens to people and, you know, he always wants to do good and this time it backfired."

Joe Gentz remains locked up in the Wayne County Jail. His brother, Steven Gentz, was stunned by Thursday's developments in court.

"I know who is right, and I know who is wrong and the truth is going to come out because that's exactly what my brother has said," Steven said. "The truth will come out eventually, isn't that what he said in the van?"

Bashara's former attorney facing contempt of court charges

(WXYZ) - David Griem, the attorney who went on network television and talked at every opportunity early in the Bashara murder case, is changing his tune.

He's not commenting, facing a criminal contempt of court hearing on Friday morning.

Griem was Bob Bashara's defense attorney until he took himself off the case this summer. At the time, he said they did not agree on defense strategy.

Griem is accused of giving evidence, police reports and witness statements to Bashara's family members in violation of a protective order issued by the court. Griem is also accused to issuing a subpoena for Joe Gentz medical records inappropriately.

This is a hearing requested by Susan Reed, the defense attorney for Gentz, who is charged with the murder of Jane Bashara. Reed has not returned a call to 7 Action News.

The Wayne County Prosecutor will also be involved in the hearing.

The hearing will be held at 9 a.m. Friday in front of 36th District Court Judge Kenneth King. The judge could find Griem in contempt and hit him with a fine or even jail time.

Grosse Pointers React to Bashara's Guilty Plea

Local residents show no surprise at Bob Bashara's guilty plea and hope case is handled with care.

All is quiet Thursday afternoon in front of Bob Bashara's house in Grosse Pointe Park just hours after he pleaded guilty to attempting to hire a hitman to kill Joe Gentz, the man accused of killing Bashara's wife Jane earlier this year.

Purple bows tied around trees in front of the tidy brick home are likely in memorial of Jane Bashara, who was found strangled in her SUV in January.

Thursday, two media outlets park on the street near the home and when neighbors see the return of cameras and microphones, they turn around and close their doors. They've surely tired of the media circus that has disrupted their quiet street in the secluded Windmill Pointe area.

On the street in the Village, passersby in Caribou Coffee and Trader Joe's are more willing to talk about the case that has brought national attention to Grosse Pointe Park. Most are not surprised by the guilty plea and all hope Jane Bashara's murder case is handled carefully by prosecutors and police.

Aaron Humphreys, a barista at Caribou, said he wasn't surprised by Bashara's pleading guilty. "I kind of expected it," he said. Humphreys admitted that he hadn't heard much lately about the case.

Tiffany Klaasen, an attorney, has watched the case unfold with interest. Of Bashara's pleading she said, "I think justice is served."

Asked if she thought additional charges would be forthcoming, Klaasen said, "I think they're (prosecutors) doing a good job of making sure they have proper evidence in bringing the case forward ... that will be a worthy case that will uphold."

After learning about Bashara's guilty plea today, an unnamed woman shopping at Trader Joe's said, "I'm not surprised. I think he was getting beat down. He knew it was just a matter of time."

"I just hope they take this thing (the murder trial of Jane Bashara) nice and slow, so they don't screw this thing up," she said.

Joe Gentz reportedly has told investigators that Bashara hired him to kill his wife. Bashara has not been charged in connection with his wife's death. Gentz is scheduled to be arraigned on charges of first-degree murder and conspiracy to commit murder at 9 a.m. on Oct. 16.

Bashara will return to court Nov. 20 at 8:30 a.m. for sentencing. Under the terms of the plea agreement, Bashara could be sentenced up to 135 months in jail for the crime.

Arraignment for Gentz delayed

Thursday, October 11, 2012 8:20 p.m. EDT

DETROIT (WKZO) -- The handyman accused of murdering a Grosse Pointe woman is scheduled to be arraigned next Tuesday (at 9 a.m. on Oct. 16.) on murder charges.

Last week, attorneys for Joseph Gentz waived a preliminary exam saying there was no strategic need for it. Law experts are speculating that there may be a plea deal in the works. Gentz is charged with murdering Jane Bashara last January. He has said that Bashara's husband Robert hired him to do so.

In the meantime, Robert Bashara is in jail on charges of solicitation of murder, accused of trying to hire a hit man to kill Gentz.

Bashara pleads guilty to hiring hit man

By Mitch Hotts

Updated: 10/11/12 09:59 pm

In an unexpected move, Bob Bashara pleaded guilty Thursday to trying to arrange the murder of handyman Joe Gentz — the man who reportedly has confessed to killing Bashara’s wife — and now faces at least four years in prison.

In a hearing that lasted less than 5 minutes, Bashara, 54, wearing a rumpled tan suit, stood before Wayne County Circuit Court Judge Bruce Morrow and pleaded guilty to one count of solicitation of murder. He then read a brief handwritten statement from a yellow legal pad.

“In June of 2012, I foolishly and regrettably offered to pay Steve Tibaudo to find someone to kill Joseph Gentz. This took place in Wayne County,” he said.

Before Bashara read his statement, Assistant Wayne County Prosecutor Lisa Lindsey told the judge that prosecutors did not enter into any plea-bargain arrangement with him.

The defendant is pleading as charged,” Lindsey said. “There is no charge reduction in this case.

In court Thursday, prosecutors say sentencing guidelines for Bashara range between 84 and 135 months, while defense attorney Mark Kriger contends the range is 51 to 85 months. But either sentence would be better than life in prison, which is the maximum punishment the solicitation to murder charge carries.

< SNIP >

Prosecutor Kym Worthy did not have a comment on Thursday’s developments and Kriger also would not say whether he expects Bashara to face additional charges.

Grosse Pointe Park Police Chief David Hiler, who has publicly named Bashara as a person of interest in his wife’s slaying, said investigators are continuing to work on the case and are closely following the court proceedings.

We are not yet done with the homicide investigation — it is continuing,” Hiler said.

Hiler acknowledged there has been criticism of his department for the pace of the investigation, but added Bashara’s plea shows Grosse Pointe Park investigators were on the right track all along.

We are conducting a thorough and complete investigation,” he said.

It’s not clear why Bashara was in court on Thursday as his trial date had been scheduled for Nov. 12. His next date will be for sentencing on Nov. 20.

The dispute between the prosecution and defense over the sentencing guidelines centers on a process known as offense variables, a system where points are added regarding a number of factors that are taken into account such as whether the defendant is a repeat offender or whether drugs were involved in the commission of the crime.

Wayne County prosecutors want what’s called an offense variable 10, which under Michigan law indicates the exploitation of a vulnerable victim such as a physical or mental disability or the offender abused his authority status. Kriger maintains there was no predatory action and therefore the variable should not apply in this case.

Meanwhile, Bashara’s former defense attorney, David Griem, is scheduled for a show cause hearing Friday afternoon on two charges in 36th District Court.

Griem allegedly shared discovery information from the solicitation case with Bashara’s mother and other relatives. Prosecutors say that’s a violation of an order that prevented information from being shared with third parties.

In a second show-cause, Griem is accused by Susan Reed, Gentz’s attorney, of filing a subpoena for a non-existent case.

Bashara's guilty plea may lead to second deal

By George Hunter and Christine Ferretti
The Detroit News

Detroit — Robert Bashara's admission Thursday that he tried to hire someone to kill the former handyman accused of murdering his wife, Jane, could be the first step toward a plea deal in her death, legal experts say.

Prosecutors in court filings have named Bashara as a suspect in his wife's murder, although he hasn't been charged in the slaying.

One legal analyst said the move could open the door for other charges against Bashara in the murder of his wife — and a possible plea deal.

"Just because he pleaded guilty to solicitation of murder, it doesn't mean prosecutors can't charge him with killing his wife," legal analyst Charlie Langton said.

Bashara pleading guilty, he said, "tells me he might be cooperating with prosecutors."

...

Assistant Wayne County Prosecutor Lisa Lindsey and defense attorney Mark Kriger agreed on most of the sentencing guidelines except for the degree of victimization in the case.

The defense is asking for a sentence of 51-85 months in prison; prosecutors are calling for 81-135 months. The charges carry up to life in prison.

"After a presentence report is prepared, the probation department will determine the guidelines," Assistant Wayne County Prosecutor Maria Miller said. "Then, there'll be arguments in court, and the judge will determine the sentence."

...

"Prosecutors may have told Bashara, 'If you plead guilty in the solicitation case, we'll only charge you with second-degree murder, rather than first-degree murder, in Jane Bashara's killing,'" Langton said.

When reached Thursday afternoon, Gentz's attorney, Susan Reed, said she'd just learned that Bashara had entered a plea.

"I have no comment now. I've had no time to think about it," Reed told The News....

More Details: What happens next

• A hearing for Bob Bashara’s former lawyer David Griem is scheduled for today (before Chief District Judge Kenneth King at 12:30 p.m. Friday, Oct. 12.) in 36th District Court in Detroit. The hearing is to determine whether Griem violated a protective order by sharing evidence and also because Griem issued unauthorized subpoenas to gather evidence about Joseph Gentz and other material.

• Gentz’s arraignment is scheduled for Tuesday (at 9 a.m. on Oct. 16.) in Wayne County Circuit Court. He is charged with first-degree murder and conspiracy in the slaying of Jane Bashara and waived his preliminary examination last week.

• Bob Bashara’s sentencing for pleading guilty Thursday to solicitation to murder is scheduled for Nov. 20 (at 8:30 a.m.).

------------

Experts: Plea is gamble

• Legal experts and those close to the case said the plea was likely made because prosecutors had a strong case.

• Kriger declined to comment after the hearing.

• Family members of Jane Bashara, who was found strangled in January, declined to comment Thursday.

"We're aware of what happened, and we don't have any comments," her sister, Julie Engelbrecht Rowe, said.

• Bob Bashara's mother also declined to comment.

• Gentz's attorney, Susan Reed, previously said her client would be willing to testify against Bob Bashara if he is charged in his wife's killing. Reed could not be reached for comment Thursday.

• Wayne County prosecutors are not sharing details — if any exist — related to admission of guilt by Bashara and the punishment guidelines they are recommending.

------------

DETROIT — A day after Bob Bashara pleaded guilty to soliciting the murder of his handyman David Gentz, his original attorney David Griem is to appear in court for a show cause hearing.

Griem was accused of disclosing information from Bashara's murder-for-hire case, in violation of a protective order, with Bashara's mother; and he is now accused of by Susan Reed, Gentz's attorney, of issuing a subpoena for a nonexistent case, The Detroit News reports.

The show cause hearing goes before Chief District Judge Kenneth King at in the 36th District Court at 12:30 p.m. Friday.

A clerk for King could not provide any further details about the hearing as of 10 a.m. Friday and said the case file was likely unavailable and in possession of the judge with the hearing time so near....

Former Bashara attorney to face judge over evidence-sharing

By George Hunter
The Detroit News

Detroit — The first attorney Robert Bashara retained after his wife was killed is scheduled to appear before a judge Friday to explain why he violated a court order by sharing evidence with his client's relatives.

David Griem represented Bashara after his wife Jane Bashara's body was found Jan. 25 in her SUV in an alley on Detroit's east side, but asked to withdraw from the case because of an unspecified breakdown in the attorney-client relationship.

Griem and co-counsel Christina Utley were allowed to withdraw, and Bashara retained Mark Kriger as his new attorney — but not before prosecutors informed 36th District Chief Judge Kenneth King that Griem had shared evidence with Robert Bashara's family after King had issued a gag order in the case.

Griem admitted to King that he shared the evidence with Bashara's mother and another relative.

In a separate matter, Griem also admitted he sent out paperwork bearing the title "The People vs. Robert Bashara," when no case yet existed.

King is scheduled to rule on whether to discipline Griem at a 12:30 p.m. show cause hearing...

Former Bashara attorney David Griem admits he wrongly shared evidence

2:19 PM, October 12, 2012

By Gina Damron
Detroit Free Press Staff Writer

The former attorney for Bob Bashara — the Grosse Pointe Park man who has been called a suspect in his wife's murder — today admitted responsibility to civil contempt of court charges.

David Griem was accused of improperly sharing evidence with Bashara's family and issuing unauthorized subpoenas. He was initially facing criminal contempt of court charges but pleaded responsibility to civil contempt of court.

Griem is due back in court Nov. 26 for a hearing about possible sanctions.

Neither Griem's attorneys nor an assistant Wayne County prosecutor would comment after the hearing.

Griem no longer represents Bashara, who pleaded guilty Thursday to a charge of solicitation to murder Joseph Gentz. Gentz, a handyman, told police he killed Jane Bashara at Bob Bashara's behest.

...

"Your honor, as someone who has been an attorney for over 35 years and takes his obligations as an attorney serious, I'm particularly embarrassed to be in this situation," Griem said to 36th District Chief Judge Kenneth King at today’s hearing. "I had notice of the protective order in this case and I did, in fact, violate it. I did not intend to violate the order, but I did not pay attention to the details, and it was my obligation to do so."

Griem also admitted he improperly issued subpoenas seeking information about Gentz, who has been charged with first-degree murder in Jane Bashara's death. Griem filed a subpoena to a company seeking Gentz's employment records. At the time, Bashara had not been charged, but the subpoena listed the case as People of the State of Michigan v. Robert Bashara.

Legal experts told the Free Press that state law has no provision allowing a defense attorney to issue a subpoena without a pending case.

"I did not intend to cause improper subpoenas to be issued, but I erred as to that matter also," Griem said today.

He apologized to the court, Wayne County prosecutors and to Susan Reed, Gentz's attorney.

"Finally, I want this court to know this is not the way I practice law," Griem said, adding that he has spent time reflecting on how he made these mistakes. "I never want to make such a mistake again."

---- TEXT & VIDEO (2:11) ----

DETROIT -
Bob Bashara’s former attorney, David Griem, pleaded responsibility Friday to civil contempt of court charges.

Griem had originally been charged with criminal contempt of court for allegedly handing over evidence to Bashara’s family members – a direct violation of a court order.

“I am in this situation because of my own mistake,” Griem told the court. “I did in fact violate it. I did not intend to violate the order, but I did not pay attention to details. It was my obligation to do so.”

Griem apologized to the court and Wayne County Prosecutor’s Office.

“This is not the way I practice law,” he said.

A sanctioning hearing is set for Nov. 26.

Griem’s hearing comes one day after Bashara pleaded guilty to trying to hire a hit man to kill the suspect who is awaiting trial in his wife’s death...

Bob Bashara spent extensive time in jail planning guilty plea deal

Bob Bashara admits he tried to have suspect in his wife's murder killed, he spent time in jail planning to resolve charge

Bashara strategically planned guilty plea while in jail

DETROIT -
Bob Bashara has been sitting in the Wayne County Jail but he hasn't been idle.

Bashara, who pleaded guilty this week to trying to have a suspect in his wife's murder killed, has been busy spending a significant amount of time meeting with his attorney and talking on the phone in his jail cell.

As the Local 4 Defenders previously reported, Bashara was blowing up the phone talking with a woman in the S&M community. The woman on the outside has been helping him tie up loose ends in some of his real estate deals.

Recently, those close to the case say all Bashara has been talking about on the jail phone, which is a recorded line, is working to get his deal done. He pleaded guilty Thursday to trying to have Joe Gentz, who is charged with murder in Jane Bashara's death, killed. Gentz also is Bob's former handyman.

The Defenders have learned investigators have been keeping close tabs on Bashara in the jail. They knew he was desperate to have this part of the investigation resolved. He called to his attorney, family members and friends for help in striking the deal. The behavior has exposed what some have called a frantic man who needed some control. Entering the guilty plea on his terms was part of the plan.

If Bashara, who is called a suspect in his wife's murder, is actually charged for Jane's death, how does the defense handle this admission of guilt?

"If he gets charged with the homicide case on Jane, it's, 'Hey listen, I wanted the man that killed my wife put away and I wasn't going to wait for the justices to do it," said Local 4 defense expert Todd Flood.

Former Bashara attorney found in civil contempt over evidence-sharing

By George Hunter
The Detroit News

Detroit — The first attorney Robert Bashara retained after his wife was killed was found Friday to be in civil contempt of court for violating a judge's order by sharing evidence with his client's relatives.

As part of an agreement with the Wayne County Prosecutor's Office, Griem on Friday accepted a finding of civil contempt, avoiding a possible ruling of criminal contempt.

Addressing King, Griem admitted violating the judge's order but said he did not do so intentionally.

"I did in fact violate it. I did not intend to violate the order, but I did not pay attention to the details when it was my obligation to do so," Griem said. "I apologize to this court."

He added later: "This is not how I practice law. I've spent a great amount of time reflecting on how I came to make these mistakes, because I never want to make this kind of mistake again."

King accepted Griem's statement and scheduled a sanction hearing for 9 a.m. Nov. 26.

Former Bob Bashara attorney David Griem accepted responsibility in court for violating a protective order in the Bashara case and will face a sanctioning hearing on Nov. 26 in 36th District Court in Detroit.

Griem apologized to the court and the Wayne County prosecutor for violating the order that prohibited information from being shared with any third party.

In another case, Griem also accepted responsibility for filing a subpoena for a non-existent case involving handyman Joe Gentz.

Another "BB wanna-be"? Smile

Another Michigan "winner, murder-for-hire" husband / ex-husband...

--------

Investigation centers on ex-husband in murder-for-hire plot

(WXYZ) - An investigation into a murder-for-hire plot targeting an Armada woman now centers on her ex-husband.

Sources say Kevin Sears, 34, was arrested at his Richmond home Thursday. He is charged with conspiracy to commit murder and conspiracy to solicit murder. Sears was denied bond during an interim bond hearing held Saturday morning.

It’s the second time Sears has been taken into custody in connection with the case . He was arrested in April 2011 along with several other people. Sears was released, but four of the other five have since been convicted on serious crimes.

Investigators say Sears’ girlfriend, Mallorie Wilson-Strat, and Sears’ sister, Christina Sears , hatched a plot to kill his estranged wife, Jessica. In their first attempt, police say the women paid $1100 to David Clark to complete the job. He broke into the house while Jessica and her three young children were sleeping, but had a change of heart and left with just her purse.

Busted: Bob Bashara's Ex-Attorney Is Found in Civil Contempt

October 13th, 2012, 8:54 AM

David Griem, a high profile attorney, was found in civil contempt of court on Friday.

The Detroit Free Press reports that Griem, the former attorney for Bob Bashara, was accused of improperly sharing evidence with Bashara's family and issuing unauthorized subpoenas.

Griem (pictured here) entered a plea of civil contempt on Friday in 36th District Court before Chief Judge Kenneth King. Up until then, he had faced the possibility of criminal contempt. Grim is slated to return to court Nov. 26 when a judge could impose a fine.

Griem pleaded responsible to civil contempt, avoiding being held in criminal contempt.

Bashara, with another attorney, just pleaded guilty to hiring a hitman to try and kill Joseph Gentz. Gentz has confessed to killing Bashara's wife Jane at the request of Bashara.

Bashara has been a person of interest in the murder, but has yet to be charged.

Griem is due back in court Nov. 26 for a sanction hearing, where he could be subject to fines.

Wow... Lot's of similarities in this case:

----------

Wife Faces Husband in Court for Alleged Murder-for-Hire Plot

ABC News(NEW YORK) -- One month after being shot in her driveway, allegedly by a hitman hired by her husband, a Texas woman appeared in court to face her estranged husband.

Nancy Howard walked into a Denton, Texas, courtroom Tuesday to move forward with her request for a divorce from her husband, John Howard.

Prosecutors say John Howard, a successful accountant who sang in a church choir, had a secret life and paid a series of alleged hitmen over $100,000 to kill his wife so he could be with his mistress in California. Nancy Howard was shot in the driveway of her Carrollton, Texas, home on August 18.

The mother of three was in a coma for days after the bullet destroyed her left eye and lodged in her lung.

"I prayed through the whole incident and called on God to save me, and he did. He carried me through," Nancy Howard told ABC News affiliate WFAA Tuesday as she walked into court.

John Howard admits to the affair that lasted four years, but denies having anything to do in his wife's shooting and has pleaded not guilty to criminal solicitation.

John Howard's attorney, Arch McColl, told ABC News that Nancy Howard really doesn't want a divorce...

Griem facing civil sanctions for actions in Bashara case

By K. Michelle Moran
C & G Staff Writer

DETROIT — Loquacious attorney David Griem — known for his colorful quotes and observations — was uncharacteristically silent after a show cause hearing on two charges against him Oct. 12 in 36th District Court Chief Judge Kenneth King’s courtroom. As part of an agreement reached among the attorneys, Griem apologized to the court and accepted responsibility for the charges on a civil level, adding that both violations — of a protective order regarding discovery materials and issuance of an improper subpoena — were unintentional.

“As someone who has been an attorney for over 35 years and takes his obligations as an attorney very seriously, I’m embarrassed,” Griem told the court. He said he “sincerely apologized” to the court, offering a mea culpa to prosecutors, investigators and others, as well.

Griem, the former defense attorney for Robert Bashara, had been accused by Wayne County prosecuting attorneys Lisa Lindsey and Robert Moran of sharing discovery materials with members of Bashara’s family, which prosecutors said violated a protective order regarding discovery materials in that case. Griem had also been accused by Susan Reed — the defense attorney representing murder suspect Joseph Gentz, whom Bashara admitted he tried to have killed — of filing a subpoena for a nonexistent case.

The attorneys spent roughly an hour conferring among themselves in the hallway, at the judge’s bench and behind the courtroom in the judge’s chambers. When open proceedings finally began, King asked Griem’s legal team why the defendant shouldn’t be held in contempt of court.

Kenneth Mogill, one of Griem’s two attorneys, offered to have Griem provide a statement of apology for civil disobedience. Lindsey called it “a plea of guilty,” but Mogill disagreed with that characterization.

“I don’t want to get hung up on words, but a plea of guilty is (used) in criminal proceedings,” he argued. King appeared to agree, saying that’s why the court uses the term “responsibility” instead.

King said criminal contempt of court involves a finding of past disobedience. After Reed, Lindsey and Moran agreed among themselves that Griem’s actions might not have been willful, King said the court could find Griem responsible for civil disobedience.

“This is not the way I practice law,” Griem told the court as part of his statement. “I’ve spent a great deal of time reflecting on how I made these mistakes, as I never want to make (them) again.”

Griem is no longer facing possible criminal charges after the hearing, which means he won’t end up behind bars, but he is still facing civil sanctions.

King said the court accepted Griem’s acknowledgement of responsibility. The judge will be determining what action should be taken against Griem during a sanction hearing at 9 a.m. Nov. 26. Because this is now a civil, not criminal, proceeding, those sanctions would likely be a fine of some sort, legal experts said.

Accompanied by his attorneys, Mogill and Jeffrey Edison, Griem declined to comment on the hearing after it was over. His attorneys also declined comment, as did Wayne County prosecutors.

DETROIT, Mich. (WJBK) -
Attorneys for the handyman charged in the murder of Detroit businesswoman Jane Bashara entered a not guilty plea on his behalf on Tuesday and he now faces trial in January.

Joe Gentz is charged with strangling Bashara in the garage of her home in Grosse Pointe Park last January. Her body was later found inside her SUV parked in an alley in Detroit.

The conspiracy charge indicates prosecutors believe Gentz did not act alone. The former handyman has maintained that he was paid by Jane's husband Bob Bashara to commit the crime but so far he is the only person charged in the case. Trial has been set for January 7.

Handyman Gentz's trial set for January

Detroit — The former handyman of Robert Bashara will stand trial Jan. 7 on charges of murder and conspiracy in the killing of Bashara's wife, Jane.

Wayne County Circuit Judge Vonda R. Evans on Tuesday set the trial date for Joseph Gentz of St. Clair Shores after he waived his right to a formal reading of the charges at his arraignment.

Gentz was ordered to stand trial earlier this month after waiving his right to a preliminary examination in 36th District Court in Detroit.

...

Gentz's attorney, Susan Reed, said after Tuesday's hearing that "(Gentz) wants (Bashara) to get as much time as possible. He said he's afraid. I get the feeling nobody believed him — that he was exaggerating with the guilty plea. It turns out he was right."

Reed added that Gentz remains jailed in isolation "for his own safety."

"Someone has already admitted that they tried to hire someone to kill him. So common sense will tell you he has a right to be nervous," Reed said.

Joe Gentz pleads not guilty in slaying of Jane Bashara

Posted: 10/16/12 11:29 am

Joe Gentz pleaded not guilty Tuesday morning to charges of first-degree murder and conspiracy to commit murder for the death of Jane Bashara in January.

After entering the plea in Wayne County Circuit Court, Gentz’s trial was scheduled by Judge Vonda Evans for Jan. 7, 2013.

Gentz, the handyman formerly of Warren and St. Clair Shores, is accused of killing Jane Bashara, 56, of Grosse Pointe Park. He reportedly told police he strangled her in her garage at the bequest of her husband, Bob Bashara. Her body was found Jan. 25, 2012 in her sport-utility vehicle in an alley on Detroit’s east side.

Gentz remains jailed while awaiting trial.

Joe Gentz vindicated by Bashara plea, attorney says

Joseph Gentz’s lawyer said Bob Bashara’s guilty plea last week vindicated her client, who expressed fear that Bashara may try to have him killed.

Attorney Susan Reed told reporters Tuesday following Gentz’s arraignment in Wayne County Circuit Court in Detroit that her client’s fears were proven to be legitimate last week when Bashara admitted to trying to pay someone to kill Gentz in jail.

“My client has said that he was afraid that Bashara was going to have him killed,” Reed said. “I sort of got the feeling that no one believed it, sort of just said, ‘Oh, he’s exaggerating.’ But obviously he was telling the truth. I think it shows my client has been telling the truth all along.”

Gentz, 48, formerly of Macomb County, on Tuesday morning pleaded not guilty to charges of first-degree murder and conspiracy to commit murder for the January slaying of Jane Bashara. Judge Vonda Evans set a Jan. 7 trial date. In custody, he appeared in jail clothes.

Reed said outside the courtroom that Gentz remains concerned about Bashara, although she noted that Wayne County Sheriff’s deputies are closely guarding and ensuring the safety of her client. He is being held in isolation at the William Dickerson Detention Facility.

“I think he has a right to be (nervous),” she said. “What if someone has tried to kill you and plead guilty to it? Would you be calm? I wouldn’t. I’d still be looking over my shoulder. So I think he has a right to be concerned and nervous about what is going on.”

Bashara, 54, pleaded guilty last Thursday to solicitation for murder. He is scheduled to be sentenced Nov. 20 by Wayne Circuit Judge Bruce Morrow. Prosecutors say sentencing guidelines for Bashara range between seven and about 11 years, while Bashara’s defense attorney Mark Kriger contends the range is about four to seven years. The maximum penalty is up to life.

Reed said her client wants Bashara “to get as much time as possible.”

Reed said Bashara’s plea did not take her off-guard in light of the evidence against him.

“I’m not surprised by it based on what I know of the prosecutor’s case,” Reed said. “Going to trial would have probably ended up in a longer sentence. I think it was a good move on the part of his attorney. It leaves the sentencing up to the judge. He couldn’t get a deal with the prosecutor. He basically had no choice.”

Police and prosecutors say Bashara in June paid $2,000 to Steve Tibaudo, a Detroit furniture store owner, to have Gentz killed in jail because Bashara was concerned about Gentz’s potential testimony in Jane Bashara’s case. Gentz, who did handyman work for Bashara, told police he strangled Jane Bashara, 56, in her Grosse Pointe Park garage at the bequest of Bob Bashara. Her body was found Jan. 25 in her SUV parked in an east-side Detroit alley.

Bashara has been named as a person of interest in the case but has not been charged. The case remains under investigation.

Regarding her client’s case, Reed said she and prosecutors have not engaged in plea negotiations, but said a plea deal is possible.

“It’s (a plea deal) always a possibility,” she said. “But right now that‘s not what we’re focused on.”

She said she and her co-counsel are concentrating on the evidence in the case, including records of telephone calls and text messages. They are reviewing three 5-inch-thick binders of documents and expect more to come.

Judge Evans set Nov. 27 as the deadline for prosecuting and defense attorneys to file motions and Dec. 4 as a final conference.

Reed said she could not discuss potential legal motions due to a gag order on evidence discussion.

Gentz to stand trial in January for murder of Jane Bashara

By K. Michelle Moran
C & G Staff Writer

A plea deal isn’t out of the question, but it also doesn’t appear to be imminent for Joseph Gentz, the 48-year-old Grosse Pointe Park handyman charged with first-degree murder and conspiracy to commit murder in the Jan. 24 strangulation of Jane Bashara.

During an arraignment on information Oct. 16 in front of 3rd Circuit Court Judge Vonda Evans, Gentz’s court-appointed attorney, Susan Reed, said her client was standing mute, so the judge entered a plea of not guilty on Gentz’s behalf. Gentz, who was ushered into court in a red jailhouse uniform, is currently being held in the William Dickerson facility in Hamtramck, where Reed said he remains in isolation for his own safety.

...

In preparation for upcoming court dates in the case, Reed said she’s going over materials including phone records and text messages. She said she has about three 5-inch binders full of documents for just this case.

Evans set Nov. 27 as the deadline for both sides to submit information in the case. A final conference and motion hearings were set, at press time, for 9 a.m. Dec. 4. A jury trial is slated to begin at 9 a.m. Jan. 7, 2013.

...

As to Robert Bashara’s recent admission of guilt in trying to have Gentz killed, Reed emphasized that Bashara “did not get a deal. He pled as charged.”

Bashara is facing a possible sentence of roughly 4-11 years in prison. Solicitation of murder can carry a life sentence, but she said Bashara’s lack of a prior criminal history and other factors led to what might seem like a light possible sentence. Bashara is scheduled to be sentenced Nov. 20.

Reed said Bashara’s attorney, Mark Kriger, steered his client in the right direction, based on evidence collected by prosecutors. That evidence included recordings of Bashara offering money to another man to hire someone to kill Gentz.

“Based on what the prosecution (had), going to trial would have probably ended in a longer sentence (for Bashara),” she said.

Came across an older (1 / 30 / 2012) comment / rumors by someone in GP ... that I found quite unique:

i am from grosse pointe and the rumors are flying. so here is what i have heard: i hear is a gambler and owed big debts. he is a landlord and he told the carpet cleaner to make sure that the capret cleaner took extra care in one of the rentals because his "girlfriend" lived there. i also heard that he has been trying to cash out her IRA's behind her back. and lastly, when he was interviewed on the news he was wearing her sunglasses - creepy.
